En virtud de que Baja Is You opera con cobros anticipados y depósitos de garantía para la confirmación de servicios, el titular reconoce y acepta expresamente que:

V. TRANSFERENCIAS DE DATOS PERSONALES

This Privacy Notice is issued by Baja Is You in compliance with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations, and the guidelines of the INAI (National Institute for Transparency, Access to Information and Personal Data Protection). By contracting our services, making a payment, or providing your data through any means, you accept the terms described herein.

- Credit or debit card data (processed by certified payment gateways: Stripe, PayPal, or CLIP; Baja Is You does NOT store full card numbers)
- SPEI bank transfer receipts or international wire transfer confirmations
- Transaction history and payment confirmations
- Email address linked to the payment method
Note: Payment processing is carried out through PCI-DSS certified platforms. Baja Is You does not store card data on its own servers.
2.4 Sensitive data
As a general rule, Baja Is You does not collect sensitive data. In the event that a specific service (water activities, diving, spa, or others) requires information on health conditions or accessibility, express, separate consent will be requested.
III. Purposes of Processing
3.1 Primary purposes — necessary for the provision of the service
- Identify the client and formalize reservations or service contracts
- Process, confirm, and manage payments for contracted services
- Issue invoices, tax receipts (CFDI), and payment receipts
- Prevent, document, and investigate chargebacks, fraud, or payment disputes before banking institutions and payment processors
- Provide vacation rental, tour, transportation, catering, spa, real estate, property management, and other offered services
- Manage communications related to the reservation or contracted service
- Comply with applicable legal and tax obligations in Mexico
3.2 Secondary purposes — marketing and service improvement
With your consent, your data may be used to:
- Send promotions, offers, or newsletters about our services
- Invite you to rate or review your experience
- Conduct satisfaction surveys
To object to the processing of your data for secondary purposes, send an email to info@bajaisyou.com with the subject “Opt-out Marketing” at any time, without affecting the provision of contracted services.
IV. Special Clause: Chargeback Prevention and Handling
Given that Baja Is You operates with advance charges and security deposits to confirm services, the data subject expressly acknowledges and accepts that:
- Payment data, reservation confirmations, contracts, electronic communications (email, WhatsApp), invoices, and proof of services rendered will be retained by Baja Is You as documentary evidence for defense against any dispute, chargeback, or claim before banking institutions, payment processors, or international networks.
- Such information may be shared with payment processors (Stripe, PayPal, CLIP), the issuing bank, and/or international payment networks (Visa, Mastercard, American Express, etc.) solely for the purpose of resolving the dispute.
- This purpose constitutes a primary processing activity necessary to protect the legitimate rights and interests of Baja Is You, pursuant to Article 37, Section VI of the LFPDPPP, and does not require additional consent from the data subject.
- Data related to payments and transactions will be retained for up to 5 (five) years from the transaction date, or the period established by applicable Mexican tax law, whichever is greater.
The foregoing applies to any payment method: online through www.bajaisyou.com, via a CLIP payment link sent by our team, bank transfer, or any other agreed-upon means.
V. Transfers of Personal Data
Your personal data may be transferred to the following recipients without requiring your consent, pursuant to Article 37 of the LFPDPPP:
- Certified payment processors (Stripe, PayPal, CLIP): for the authorization and secure processing of transactions and dispute resolution.
- Banking institutions and international payment networks: when necessary for chargeback management.
- Operational providers and partners: collaborating companies for transportation, catering, activities, spa, décor, or other services participating in the provision of the contracted service, only to the extent necessary.
- Competent authorities: SAT (tax authority), PROFECO (consumer protection), immigration authorities, or other government bodies when required by law.
- Website operating platforms (WordPress/WooCommerce) for the management of online orders and reservations.
Outside the above cases, Baja Is You will not transfer data to third parties without your prior written consent. For international clients, the transfer of data outside Mexican territory is carried out under Article 37 of the LFPDPPP and under the security terms of the payment processors, who hold international certifications (PCI-DSS, GDPR, etc.).
VI. ARCO Rights and Mechanism for Exercising Them
At any time, you have the right to:
- Access your personal data held by Baja Is You
- Rectify your data when it is inaccurate or incomplete
- Cancel your data when it is no longer necessary for the purposes that justified its processing
- Object to the processing of your data for specific purposes
(These are known collectively as ARCO rights — Access, Rectification, Cancellation, Opposition.)
Procedure to exercise your ARCO rights:
- Send your request in writing to info@bajaisyou.com with the subject “Exercise of ARCO Rights.”
- Include: full name, a clear description of the right you wish to exercise, and a copy of valid official identification.
- Baja Is You will respond within a maximum of 20 business days from receipt of the request.
- The response will be issued within the following 15 additional business days if the request is deemed valid.
To revoke consent previously granted, follow the same procedure, indicating the scope of the revocation. This will not affect processing carried out previously, nor the primary purposes linked to the fulfillment of contractual or legal obligations.

This Privacy Notice is governed by the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations, and the INAI guidelines in force in the United Mexican States. For clients residing in the United States of America, Baja Is You applies, where applicable, the principles of the California Consumer Privacy Act (CCPA) for those who so request. Any dispute arising from this Notice shall be subject to the jurisdiction of the competent courts of the state of Baja California Sur, Mexico.
XI. Consent and Acceptance — Signature of the Data Subject
By signing this document, the data subject declares:
- Having read, understood, and fully accepted this Comprehensive Privacy Notice of Baja Is You.
- Granting express and informed consent for the processing of their personal data in accordance with the purposes described, including those relating to the prevention and documentation of chargebacks (Section IV).
- Acknowledging that payments made — whether online, via a CLIP payment link, or by bank transfer — are governed by the terms established herein.
